Chlorine Leak Injures Almost 40

On Wednesday, March 26, a chlorine gas leak in a pool injured 36 students and one adult. Rocori High School is the same school where two boys were killed in a shooting over four years ago.

No one was critically injured, but twelve students and the injured adult had to stay over night at St. Cloud Hospital for further treatment. The leak was found just before 2 p.m. and the building was evacuated. Officials had the leak contained within one hour and are now investigating the cause of the leak.

Nearly 20 students were in gym class when they saw bubbles coming out of the pool drain, Superintendent Scott Staska said. The water supply had been shut off for routine work in "back in the chemical room, actually," he said, and had just been turned back on. The bubbles might just have been from air in the pipes, he said. But the students began feeling sick shortly afterward.

The leak occurred during a 9th and 10th grade gym class in which some of the students were using the pool. The school opened as scheduled on Thursday, but the pool will stayed closed for investigation. Chlorine gas can damage the eyes, skin, throat or lungs but long-term health problems are unlikely.

Civil Suit Over Teen's Fall Dismissed

Steven and Vicky Treichel filed a lawsuit on their son's behalf over a fall that happened at Fonferek Glen Park. Justin Treichel was 16 when he fell down a cliff at the park in 2004.

He had been playing paintball with friends and broke both legs and bones in his face and jaw. The lawsuit was asking for compensation for medical bills and the parents' lost wages. Judge Peter Naze dismissed the suit.

In his summary judgment, Naze noted recreational activity was immune from liability. Also, there were five signs posted in the 74-acre park warning visitors about steep cliffs and rugged terrain and to exercise caution.
"Plaintiffs have not identified any valid exception to recreational immunity. Consequently, summary judgment is granted," Naze wrote.

The family has not announced if they will appeal. Prohibited activities at the park include paintball.

Hospital Sued For Doctor's Bad Touch

St. Mary's/Duluth Clinic is named as a defendant in a lawsuit filed by three former employees who charge they were touched inappropriately by a doctor to whom they were referred when they suffered job--related injuries.

The lawsuits allege that SMDC breached its duty of care to the plaintiffs by failing to remove from employment or take actions against individuals such as Downs that they knew or should have known constituted a hazard to others.

Each of the women is asking for more than $50,000 in damages. Davis' and Gerard's husbands are also named as plaintiffs seeking more than $50,000 for loss of their wives' "services and consortium" -- the legal right of one spouse to the company, affection and assistance of the other.
